반기문 사무총장에게 보내는 공식 항의서
: 법과 정의를 지키지 않겠다면 사임하라!

인류애와 얼마 남지 않은 국제법에 대한 신뢰를 위하여
: 반기문 사무총장은 법과 정의를 지키지 않겠다면 사임하라!
반기문 사무총장님,
여기 서명된 팔레스타인 인권기구와 지역기반 기구들은 사무총장님의 발표 중에서 특히 편향된 진술들, 그 어떤 조치도 없었던 일, 이미 전쟁범죄에 이른 이스라엘의 국제 인도법 위반에 대한 부적절한 정당화로 인해 극도로 실망했습니다. 사무총장님은 점령지 팔레스타인에서 6월 13일 이후로 최근까지 이어진 이스라엘의 공격에 대처함에 있어 오늘까지도 그 어떤 확실하고 실질적인 조치를 취하시지 않았습니다. 더욱이 사무총장님의 성명서는 이스라엘의 사실 왜곡을 인정하고 조장하기 때문에, 혹은 성명서에 나온 말들이 이스라엘의 국제법 위반과 범죄를 정당화하기에 진실을 호도하는 한편, 국제법으로 마련된 조항들과 이를 지키는 이들의 입장과는 반대됩니다.
의심할 여지없이 사무총장님은 이스라엘이 점령지 팔레스타인에서 벌이고 있는 불법적 행동을 명확히 규탄하지 못함으로써 최근 가자지구 공격과 서안지구에서 이스라엘이 자행하고 있는 국제법 위반에 대해 편향된 자세를 취하고 계십니다. 반면, (때로는 실수로) 가자지구에서 팔레스타인 전투원들이 국제법을 위반했다는 비난에는 주저함이 없습니다. 이러한 편향된 자세는 다음 발췌문에서 나타납니다.
“UN 사무총장은 라파에 주재하여 수 천명의 민간인들에게 대피소를 제공하고 있는 국제연합 팔레스타인 난민구제 사업기구(UNRWA)가 운영하는 학교 외부에 폭격하여 최소 팔레스타인인 10명이 숨지게 한 사건을 강력하게 규탄한다. 이 공격은 다른 민간인 시설들 사이에 있는 팔레스타인 민간인, UN 직원들과 건물들 모두에 대한 보호를 명확히 요구하는 국제 인도법에 대한 또 다른 중대한 위반이다.”
이 성명서에는 가해자(이스라엘)가 지명되지 않았기에 편향된 것일 뿐 아니라 가자의 팔레스타인인들에게 구호와 보호를 제공하기 위해 분투하는 기타 UN기구들과 국제기구들을 비롯하여 그 자체로 UN기구인 국제연합 팔레스타인 UNRWA에 대한 모욕입니다. UNRWA는 이스라엘이 프로텍티브 엣지 작전(Operation Protective Edge)을 개시한 이래로 가자에서 9명의 직원이 목숨을 잃었는데 대피소 안에 27만명 가량의 내부 난민들을 피신시킨 상태입니다. 이전에 UNRWA 학교 중 한 곳이 공격받은 사건에 대한 예비분석에는 학교가 이스라엘 포병대의 공격을 받았음이 암시되어 있는데, 이는 무차별적 공격에 다름없으며 거의 전쟁범죄나 마찬가지입니다.
더욱이, 성명서에는 완전히 상세한 사항들과 국제법에 대한 적절한 설명도 없이 UNRWA 학교에서의 무기 보관을 규탄함으로써 이스라엘이 민간인들을 불법적이고 무차별적으로 목표물로 삼는 일에 대한 변명으로 용인되고 있습니다.
더구나 “보도에 따르면 상호간에 합의되어 오늘 아침에 시작된 인도적 휴전을 하마스가 위반”한 일을 규탄하면서 “이 과정으로 인하여 충격을 받고 깊이 실망한 상태”라고 하는데, “사무총장이 UN은 정확히 무슨 일이 일어났는지 입증할 독립적인 수단이 없다는 것을 언급했음”을 인정한다고 해도, 하마스에 휴전 위반의 책임을 전가함과 더불어 “(아마도 잘못 언급된) 포로병들을 즉각적이고 무조건적으로 석방할 것”을 요구하시면서 이스라엘의 사실 왜곡에 대한 부주의한 승인을 그대로 드러내고 계십니다.
다음 진술은 사무총장님의 정황상 사실에 대한 무지를 나타내고 있습니다.
“사무총장은 염려하면서도 오늘 밤 이스라엘 방위군이 가자지구 북쪽에서 수 만명의 주민들에게 집을 떠나 가자 시로 피난하라고 경고하는 리플렛을 뿌렸다는 것을 보도를 통하여 알게 되었다.”
만약 사실이라면, 이는 이 지역 가자지구에서 포위된 민간인들에게 있어서는 더욱 끔찍한 인도주의적 여파를 끼친 것인데, 이들은 최근에 이미 엄청난 고통을 겪어왔습니다.
이스라엘이 가자에서 작전을 시작한 이래로 전단지를 투하하는 일은 알려진 행위입니다. 이로 인해 48만명 이상의 사람들이 내부적으로 난민이 되는 결과를 낳고 말았습니다.
동일한 성명서에서, “사무총장은 양측 모두 지금 이 시간에 더 이상의 긴장상태를 피할 것을 촉구하며 양측 모두 그 어떤 군사적 대응에 있어서도 균형을 유지할 뿐 아니라 곧 이어질 공격에 앞서 민간인들에 대해서도 국제 인도법의 의무사항들을 준수해야 함을 지시하고자 한다”고 했습니다.
성명서는 이 분쟁에서 양측을 부적절하게 동일선상에 두면서 대다수가 민간인들인 1,814명을 희생시킨 이스라엘이 저지른 국제 인도법 위반이 불러올 더 큰 여파에 대한 검토는 없습니다.
사무총장님,
그 모든 성명서에서 억압자와 희생자를 구분하지 않는다면,
특정한 행동에 대한 언급에 있어서 그랬듯이 이스라엘을 지목하지 않으면서 팔레스타인 전투원들을 법을 위반한 가해자이자 전쟁범죄자로 지목한다면,
팔레스타인인들의 대응을 중대한 국제 인도법 위반으로 규정하는 일을 고집하면서 이스라엘의 행위가 전쟁범죄에 이르렀음을 명기하지 않는다면,
팔레스타인인들이 점령, 식민화, 제도화된 차별에 저항할 정당하고 합법적인 권리는 지적하지 않으면서 항상 이스라엘의 자위권은 불법적으로 지지한다면,
팔레스타인인들의 목소리는 언급하지 않으면서 이스라엘의 잘못된 이야기를 받아들이고 지지한다면,
전장에서 잘못 잡힌 병사의 즉각적이고 무조건적으로 석방을 요구하면서 이스라엘의 공격으로 인한 명확한 정황상의 사실을 무시한다면,
사무총장님은 평화와 안보를 주장하시는 것도 아니요,
인권을 보증하시는 것도 아닙니다.
사무총장님의 진술에 대한 검토를 통해, 주어진 권한을 이행해 오지 않으셨다는 것이 분명해졌습니다. 반대로, 사무총장님의 진술을 통하여 이스라엘이 팔레스타인 민중들을 학살을 계속하는 것을 허락받았을 뿐 아니라 미국으로 하여금 이스라엘에게 계속해서 면책을 주게끔 권장하고 있습니다. 사무총장님이 진실을 말씀하시지 않기에, 우리는 말 뿐이 아니라 UN을 통하여 효과적으로 현 분쟁을 종식시키려는 노력으로서 입장을 전적으로 바꾸시거나 아니면 사임하시라는 충고를 드립니다. 사무총장님이 이러한 역할을 계속하시겠다면 이스라엘이 우리의 가정, 자녀, 여성, 노인을 포함한 팔레스타인 민중에게 지속적으로 자행하는 국제 인도법 위반의 파트너이거나 적어도 조력자라는 민중의 느낌을 우리에게 입증해주는 일이 될 것입니다.
